A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-2-11a, relating to prohibiting moneys from any state fund or funding source to be expended for any abortion unless the abortion qualifies for federal funding under Medicaid.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §9-2-11a, to read as follows:
ARTICLE 2. COMMISSIONER OF HUMAN SERVICES; POWERS, DUTIES AND RESPONSIBILITIES GENERALLY.

§9-2-11a. Limitation on use of funds.
(a) Notwithstanding any provision of this code to the contrary, no moneys received or controlled by or transferred from any state fund or funding source may be expended for any abortion.
(b) The limitation established in the preceding subsection does not apply to an abortion that qualifies for federal funding under the Medicaid program.





NOTE: The purpose of this bill is to prohibit moneys from any state fund or funding source to be expended for any abortion unless the abortion qualifies for federal funding under Medicaid.
